It has been said that all trials are a contest between two sides whose lawyers have advised them that they are going to win!
Our Senior Mediator, Martin Plowman, has mediated over 1,000 cases, and he is consistently impressed by the standard of legal representation and advice provided in mediations. Yet opposing lawyers, even working on the same facts, and even when both give impeccable advice, can often assess litigation risk, and therefore the commercial settlement value of a case, differently. Why?
Drawing on his own experience in mediations, as well as the work of Nobel prize winning scientists, and with the help of two goats, a fast car, and a hungry dinosaur, in this course Martin highlights some of the cognitive biases that are hard wired into the human brain and which can lead to different risk assessments on different sides. Attendees are thereby enabled to improve their own risk analysis, and assisted in understanding why the other side may have a different analysis.
The course is aimed at litigation lawyers. It runs for one and a half hours.
